State Agency Procurement
The New York State Procurement Council, established under State Finance Law, Article XI, Section 161, is responsible for the study, analysis, and development of recommendations to improve state procurement policy and practices; and for the development and issuance of the following guidelines governing state agency procurement.

Required Reports
- In accordance with State Finance Law § 161(4), the Commissioner of General Services (as chair of the Council) is required to submit a report each year by December 31 to the Governor, the Legislature, and the Director of the Budget regarding any modifications to or rejections of the rules and regulations proposed by the Council, if any. See 2022 Report on Modifications and/or Rejections of the Rules and Regulations Proposed by the State Procurement Council.
- In accordance with State Finance Law § 162(8), the Council is required to submit a report each year by December 31 to the Governor, the legislative fiscal committees, and the Director of the Budget regarding the denial of any application to add an item to the list of preferred source commodities and services, the reasons for such denial, whether such denial was appealed to the Commissioner of General Services, and the final decision by the Commissioner. - In accordance with State Finance Law § 161(2)(k), the Council is required to submit a report every other year by December 31 to the Governor, the Legislature, and the Director of the Budget regarding significant findings of the Council. Members and Proceedings
The New York State Procurement Council meets quarterly at the Empire State Plaza in Albany. Members include the State Comptroller, Director of the Budget, and Commissioners of Economic Development and General Services (all ex-officio); seven heads of large and small state agencies appointed by the Governor; eight at large members; and two non-voting observers appointed by legislative leaders.
The NYS Procurement Council will meet in 2024 on the following dates: February 7, April 3, August 14, and October 16. All meetings are scheduled for 11:30 AM – 1:30 PM in Meeting Room 6 on the Empire State Plaza in Albany, NY.
