CL-703: Revision to the Procurement Stewardship Act with Regard to Vehicles

To All State Agencies:

In June 2008, Section 43 of the State Finance Law was revised to remove the restrictions on the lease and purchase of vehicles by departments, agencies or public benefit corporations of the state government.

Previously, state entities requiring vehicles not specifically listed on OGS centralized contracts had to request OGS bid the vehicle requirement for them (lease or purchase). This is no longer the case. Agencies will now be allowed to bid these vehicle requirements themselves, if the vehicle they desire is not on OGS contract.

Agencies are still required to follow the form, function and utility guidelines and document for the record why the centralized contract does not meet their needs.
