Sample Contract Language

To support compliance with NYS policies and GreenNY procurement requirements, contract managers are encouraged to incorporate the GreenNY Sample Contract Language into bid solicitations and contracts. The GreenNY sample contract language covers the following topics:

Product-Specific Sample Contract Language

In addition to the GreenNY Sample Contract Language, contract managers are encouraged to include the following language in vendor contracts involving Battery-Powered Vacuum Cleaners:

Pursuant to NYS Battery management and disposal law (ECL § 27-0719), for all products offered on this contract that possess a rechargeable battery, the battery must be removable and clearly marked with its chemical content, so that it is easily identifiable by consumers, collectors, and recyclers. 

In order to prevent environmental pollution and promote compliance with NYS Rechargeable battery recycling law (ECL § 27-1807), the vendor MUST offer collection and recycling services for rechargeable batteries through a battery recycling program approved by the Contract Manager.

At the request of the purchaser, the vendor must provide verification of compliance with ECL § 27-0719 and ECL § 27-1807. Verification documentation may cover services that apply to multiple products that are distributed, sold, or offered for sale by an individual vendor. The following types of verification documentation will be accepted:

  • Compliance certification or affidavit signed by the manufacturer or vendor
  • Product technical data sheet
  • Third-party certification
  • Other acceptable documentation as approved by the purchaser

Definitions

  • Carpet Extractor – A cleaning machine that uses pressure, water/cleaning solution, and suction to extract deeply embedded dirt and stains from carpeting. Often referred to as a carpet cleaner.
  • dBA – A-weighted decibels (dBA) are a measure of sound level. It is an adjusted form of decibels (dB) that reflects how the human ear perceives sound.
  • Floor Polisher/Burnisher  – A machine that uses rotating brushes or pads to clean, polish, and buff floors.
  • Floor Scrubbing Equipment – A machine that cleans floors by applying a cleaning solution, scrubbing, and removing residue.
  • Rechargeable Battery – A battery that can be reused (typically hundreds of times) once its energy content has been depleted by being recharged in a charger.
  • Vacuum Cleaner – A device that has been tested and certified to effectively remove soil from carpets using air flow, containing dust within the machine, and maintaining the quality of the carpet appearance.
