Product-Specific Sample Contract Language
In addition to the GreenNY Sample Contract Language, contract managers are encouraged to include the following language in bid solicitations and vendor contracts involving Computers and Displays:
Pursuant to the Manufacturer collection; recycling surcharge section of NYS Electronic Equipment for Recycling and Reuse Act (ECL § 27-2603), manufacturers of electronic equipment must accept electronic waste for which it is the manufacturer for collection, handling, and recycling or reuse. For a list of covered electronic equipment manufacturers and their electronic waste acceptance programs, visit the NYS Department of Environmental Conservation website.
Pursuant to NYS Organohalogen Flame Retardant Restrictions in Electronic Displays law (ECL § 37-1007), vendors shall not sell or offer for sale electronic displays that contain intentionally added organohalogen flame retardant chemicals.
Pursuant to NYS Appliance and Equipment Efficiency Standards Act of 2022 and Article 16 of the State Energy Law, vendors shall not sell or offer for sale appliances and electronic equipment that do not meet the NYS Appliance and Equipment Efficiency Standards. For computers and displays, New York State has adopted California’s Title 20 Appliance Efficiency Standards. Compliant products can be found in California’s Modernized Appliance Efficiency Database System (MAEDbS).
Definitions
- Computer: A computer is a device which performs logical operations and processes data. Computers are composed of, at a minimum:
- A central processing unit (CPU) to perform operations. If no CPU is present, then the device must function as a client gateway to a server which acts as a computational CPU;
- User input devices such as a keyboard, mouse, or touchpad; and
- An Integrated Display screen and/or the ability to support an external display screen to output information.
- Desktop Computer: A desktop computer is a computer whose main unit is
designed to be located in a permanent location, often on a desk or the floor. Desktop computers are not designed for portability and are designed for use with an external display, keyboard, and mouse.
- Electronic Display: Per § NYECL 37-1001, an electronic display is a consumer product with a display screen and associated electronics that, as its primary
function, displays visual information from wired or wireless sources and is
available for purchase by individuals or households for personal use in a
residential space. Electronic display shall not include: (a) any electronic display with a screen area smaller than or equal to one hundred square centimeters or
fifteen and one-half square inches; (b) projectors; (c) virtual reality headsets; (d) all-in-one video conference systems; or (e) displays that are integrated with
appliances and are not available for purchase as separate products by end-users.
- Integrated Desktop Computer: An integrated desktop computer is a desktop computer in which the computing hardware and display are integrated into a
single housing, and which is connected to ac mains power through a single cable.
- Notebook Computer: A notebook computer is a computer designed specifically for portability and to be operated for extended periods of time both with and
without a direct connection to an ac mains power source.
- Tablets/Slate: A tablet/slate is a computing device designed for portability that meets the following criteria:
- Includes an integrated display with a diagonal size greater than 6.5 inches and less than 17.4 inches;
- Lacking an integrated, physical attached keyboard in its as-shipped configuration;
- Includes and primarily relies on touchscreen input; (with optional keyboard);
- Includes and primarily relies on a wireless network connection (e.g., Wi-Fi, 3G, etc.); and
- Includes and is primarily powered by an internal battery (with connection to the mains for battery charging, not primary powering of the device).
- Portable All-In-One Computer: A portable all-in-one computer is a computing device design for portability and meets the following criteria:
- Includes an integrated display with a diagonal size greater than or equal to 17.4 inches;
- Lacking keyboard integrated into the physical housing of the product in its as-shipped configuration;
- Includes and primarily relies on touchscreen input; (with optional keyboard);
- Includes wireless network connection (e.g. Wi-Fi, 3G, etc.); and
- Includes an internal battery
- Thin Clients: A thin client is an independently powered computer that relies on a connection to remote computing resources (e.g., computer server, remote workstation) to obtain primary functionality. Main computing functions (e.g. program execution, data storage, interaction with other Internet resources) are provided by the remote computing resources.
- Workstation: A workstation is a high-performance, single-user computer typically used for graphics, CAD, software development, financial and scientific
applications among other compute-intensive tasks. A device is considered a workstation if it meets two or more of the following criteria:- Supports one or more discrete GPU or discrete compute accelerators
- Supports four or more slots of PCI-express, other than discrete GPU,
connected to accessory expansion slots or ports where each lane has a
bandwidth of 8 gigabits per second (Gb/s) or more. - Provide multi-processor support for two or more physically separate processor packages or sockets. (this requirement cannot be met with support for a single multi-core processor); and/or
- Certification by 2 or more Independent Software Vendor (ISV) product
certifications; these certifications can be in process, but partner shall ensure they are completed within 3 months of certification.
- Monitor: A monitor is a product with a display screen and associated electronics, that as its primary function produces visual information from a computer,
workstation, or server via one or more inputs (e.g., VGA, DVI, HDMI, DisplayPort, IEEE 1394, USB), external storage, or a network connection. Monitors are intended for one person to view in a desk-based environment.
- Signage Display: A signage display is a product with a display screen and
associated electronics, that as its primary function produces visual information
from a computer, workstation, or server via one or more inputs (e.g., VGA, DVI, HDMI, DisplayPort, IEEE 1394, USB), external storage, or a network connection. Signage displays are intended for multiple people to view in non-desk-based
environments such as conference rooms, classrooms, restaurants, etc. A display is classified as a signage display if it meets three or more of the following criteria:- Diagonal screen size is greater than 30 inches;
- Maximum Reported Luminance is greater than 400 candelas per square meter;
- Pixel density is less than or equal to 7,000 pixels per square inch;
- Ships without a mounting stand designed to support the display on a desktop, or is configured to be mounted vertically on a wall; or
- Contains RJ45 or RS232 physical ports.
