12.5. If a vendor or contractor violates the State Finance Law §§139-j and 139-k, what are the penalties? (Last Updated: 6/14/2010)

If it is found that an Offerer has knowingly and willfully violated State Finance Law §139-j (3), the Offerer and any of its subsidiaries and related or successor entities will be determined to be a non-responsible bidder and shall not be awarded the contract. A subsequent finding of non-responsibility by the vendor or contractor within four years of a prior determination of non-responsibility results in the vendor or contractor being ineligible to submit a proposal on or be awarded any procurement contract for four years from the date of the second finding of non-responsibility.
