The OGS Real Estate Planning Program leases privately owned space for all Executive Branch state agency operations. As such, OGS seeks to identify and negotiate the best quality space at the best value on behalf of our client agencies. General Lease Requirements
All property offerings by prospective landlords will be evaluated and, if selected, will require the approval of several departments. At a minimum, properties must be:
  • Asbestos hazard free upon occupancy;
  • Built to OGS plans and specifications; and
  • Comply with all applicable building codes, including the Americans With Disabilities Act and the New York State Uniform Fire Prevention and Building Code.

In addition, state entities procuring leased space are directed to incorporate energy-efficient design, operations, and management practices in compliance with the requirements of Executive Order 111, Energy Efficiency and Green Buildings. Consistent with New York State Procurement Lobbying Law, there are certain restrictions on communication between an offeror, the state, and any tenant representative during the procurement process. For more information, view the Advisory Council on Procurement Lobbying web page.
