The following are recommended guidelines to govern the use of food preparation devices and cooking demonstrations within the assembly spaces of the Empire State Plaza. Additional items may be forthcoming upon review of specific applications not listed here. It is recommended that, where possible, all processes and demonstrations take place under the protection of a building sprinkler system.
These guidelines are based on applicable provisions of the Fire Code of New York State (NYSFC) and the National Fire Protection Association Life Safety Code (LSC). These guidelines supersede those issued on 9/16/02 and reflect the code changes as a result of New York State's adoption of the International Family of Codes and subsequent updates.
- The stage and assembly seating areas are protected by an automatic sprinkler system.
- Seating areas conform with the requirements of the Building Code of New York State for smoke-protected assembly seating. The Office of Fire Prevention and Control should review the stage set up and seating arrangement for all acts. (NYSFC 308.3.5)
- Post a fire watch during the performance, with such fire watch being equipped with portable fire extinguishers of an appropriate size, type and knowledge of use. (NYSFC 308.3.5)
- No apparatus in which combustible or flammable fuels in portable containers are used in the preparation of foods, refreshments, or other materials shall be permitted in a lobby, exit way, corridor or foyer of a place of assembly.
- Electric devices used shall not overload available circuits. Personnel desiring to use these devices should coordinate with the appropriate Building Management/OGS personnel to assure that the devices will not exceed current capacity.
- Portable Liquid Petroleum (LP) gas containers are allowed to be used temporarily for demonstrations and public exhibitions. Such containers shall not exceed a water capacity of 2.5 pounds (1.05 pounds of propane). (NYSFC 3803.2.1.5)
- Commercial cooking devices which are designed to be permanently installed and used in conjunction with a hood exhaust system shall not be allowed in these spaces. (NYSFC 609)
Cooking demonstrations, which are intended to be performed in conjunction with a specific show or group of exhibits, shall meet the following items.
- Demonstrations should be scheduled events of the program, with the intent to demonstrate a device or process and not continual cooking during the program for the purpose of selling/sampling the food during the event.
- Where more than one such LP container is present in the same room, each container shall be separated from other containers by a distance of not less than 20 feet. (NYSFC 3803.2.1.5)
- Cooking devices shall be isolated from the public by at least 4 feet or by a barrier between the devices and the public.
- Devices shall be restricted to single-well cooking equipment and designed as a portable device.
- Single-well cooking equipment using combustible oils or solids shall:
A minimum 10-B:C fire extinguisher shall be provided within the booth for each device, or an approved extinguishing system. (NYSFC 308.3.5)
Combustible materials within the booth shall be limited to a one-day supply. No combustible storage shall be allowed behind the booth.
Plans for the event shall be reviewed and approved by OFPC Fire Safety Detail as the agent for the Authority Having Jurisdiction. (NYSFC 308.3.5)
- Have lids available for immediate use;
- Be limited to 288 square inches of cooking surface;
- Be placed on noncombustible surface materials;
- Be separated from each other by a minimum horizontal distance of 2 feet unless multiple single-well devices aggregate cooking surfaces do not exceed 288 square inches; and
- Be kept at least 2 feet from any combustible material.
